Pole Vault Pole Lease/Rental Agreement

Masters T&F Support Depot, Inc., a non-profit corporation created for the purpose of providing support and equipment to masters track and field athletes (hereinafter referred to as “The Support Depot”) is renting Pole Vault Poles (“poles”) to the user (the “Lessee”) and Lessee agrees to the terms and conditions herein. This Lease/Rental Agreement (“Agreement”) and rental of poles commences when the Lessee retrieves the pole. The Lessee will return the pole within one hour after the Lessee’s Pole Vault Competition ends. This Agreement ends when the Lessee returns the pole. The return of the pole is complete when the pole is returned to and accepted by the onsite the Support Depot personnel.

As Lessee I understand that there are no refunds after the execution of this Agreement and rental of the poles. I agree not to loan, rent, or lease the poles to any other person and understand that only leased poles will be accepted for return. I agree to return all poles in the same condition in which the poles were received by me, ordinary wear and tear excepted. Regardless, I understand and agree that there will be a charge for any poles damaged, destroyed, lost, or unreturned. All poles will be inspected upon return. Any deep scratches, gouges or damage to the pole will result in a fee ranging from $100.00 to the current retail price of the pole, plus freight charges. If the pole is lost, unreturned, or determined to be unsafe for use or if the pole is broken, the charge will be the current retail price of the pole, plus freight charges.

The complete list of poles on the event webpage constitutes the poles available for rental. No modifications may be made to the poles. Lessee must inform the Support Depot if poles are damaged or not working properly before leaving the Pole Vault Competition.
I UNDERSTAND HOW POLES ARE USED, INCLUDING THE FUNCTIONING OF THE POLES AND OTHER SAFETY FEATURES. ONCE RECEIVED, I WILL EXAMINE THE POLE BEING RENTED AND VERIFY IT IS IN GOOD CONDITION PRIOR TO USE.

Only the Lessee and other competitors who have executed this Agreement are permitted to use the pole.

The Lessee may return the pole and exchange it for a different pole at any time.

I understand and accept that pole vaulting can result in injury, including serious injury. I understand and accept that by entering into this Lease/Rental Agreement with the Supply Depot, I am fully and intentionally assuming all of the risks associated with pole vaulting, including injury resulting from attempting to pole vault. Except for any gross negligence on the part of the Supply Depot, Lessee fully and completely releases, indemnifies, and holds harmless (including any attorney fees and costs incurred) the Supply Depot, USATF Masters Track & Field Committee, the USATF Masters Track & Field Championships Games Subcommittee, USATF, Alachua County Sports and Events Center, the USATF Florida Association, all members, agents and volunteers of the Supply Depot, all agents and volunteers of USATF Masters, Gainesville Sports Commission, Alachua County Sports and Events Center, RADDSports Inc., the USATF Florida Association, the local organizing committee and their agents, servants, volunteers, and employees for any claims, expenses, and injuries including medical expenses and attorney fees, or any damages resulting from the use of the poles. I understand and agree to the terms of this agreement.
